Visa option for the USA

VISA for the USA is complicated especially for students and employees going for the first time.

The United States supports international education and welcomes foreign students and exchange visitors.

Before applying for a visa, students and exchange visitors must be accepted by their schools or program sponsors.

Here are the categories for student visas in the USA: 

Student Visa’s F M: For academic and vocational studies

Exchange visitor visa J: For participation in an approved exchange program.

Visitor visa B: For visiting schools before or during the application process, and/or participating in short recreational, non-credit courses.

Your course of study and the type of school you plan to attend determine whether you need an F visa or an M visa.

F visa is needed for university or college students, high school, private elementary school, seminary, conservatory, and another academic institution, including a language training program

M visa is needed for Vocational or other recognized non-academic institutions, other than a language training program

For short periods of recreational study, a Visitor (B) visa may be appropriate. A visitor (B) visa permits enrolment in a short recreational course of study, which is not for credit toward a degree or academic certificate.

To work in the United States temporarily as a lawful non-immigrant, temporary workers must qualify for the available visa category based on the planned employment purpose.

A temporary worker visa for an employee has the following options:

H-1B: To work in a specialty occupation. Requires a higher education degree or its equivalent.

H-1B1: To work in a specialty occupation. Requires a post-secondary degree involving at least four years of study in the field of specialization.

H- 2A:  For temporary or seasonal agricultural work.

H- 2B: For temporary or seasonal non-agricultural work

H-3: To receive training, other than graduate medical or academic, that is not available in the trainee’s home country or practical training programs in the education of children with mental, physical, or emotional disabilities.

L: To work at a branch, parent, affiliate, or subsidiary of the current employer in a managerial or executive capacity, or in a position requiring specialized knowledge.

O: For persons with extraordinary ability or achievement in the sciences, arts, education, business, athletics, or extraordinarily recognized achievements in the motion picture and television fields, demonstrated by sustained national or international acclaim, to work in their field of expertise. 

P 1: To perform at a specific athletic competition as an athlete or as a member of an entertainment group.

P 2: For performance under a reciprocal exchange program between an organization in the United States and an organization in another country

P 3: To perform, teach or coach under a program that is culturally unique or a traditional ethnic, folk, cultural, musical, theatrical, or artistic performance or presentation.

Q 1: For practical training and employment and for sharing the history, culture, and traditions of your home country through participation in an international cultural exchange program.

Depending on the nature of employment or the qualifications of the employee, they can choose any one of the visa options.

To apply for the Visa, the employee will need to get their ‘petition for a non-immigrant worker (I-129) approved by the USCIS.

An employee can apply for the visa online by completing the DS-160 form. They need to bring a printout of their completed form to the interview.

While completing the online form employee is required to upload a current passport-sized photograph of them as well.

The employee must schedule their visa interview at the U.S. Embassy or Consulate in the country they are applying from.

For the visa interview employee is required to have the following documents:

  • Passport
  • Non-immigrant visa application form (DS-160) confirmation page
  • Photo
  • The receipt number of the approved petition (I-129)
  • Family relationships with dependent (If any)
  • Financial statements

If an employee wishes to relocate with their spouse and children, they may also apply for the same visa category as the employee. 

The employee must be able to show that they will be able to financially support their family in the United States. 

A foreign national traveling to the United States for tourism needs a visitor visa (B-2) 

Generally, a citizen of a foreign country who wishes to enter the United States must first obtain a visa, either a non-immigrant visa for a temporary stay or an immigrant visa for permanent residence. Visitor visas are non-immigrant visas for persons who want to enter the United States temporarily for business (visa category B-1), for tourism (visa category B-2), or a combination of both purposes (B-1/B-2).
